Terms of use
Edition 1 of
1. About these terms
These terms are an agreement between you and the operator of GymDay (section 2). They apply whenever you use GymDay: on the gymday.fit website, in the iPhone app — with an account or without one — and through an AI assistant you have connected to your account.
When you create an account, you accept these terms by ticking the box at sign-up. If you use the app without an account, you accept them by using it. If you do not agree with these terms, do not use the service.
How we process personal data is described in the Privacy policy.
The Russian version of these terms is the main one. Versions in other languages are translations; if they differ, the Russian version applies.
2. Operator
The GymDay service — "the operator", "we" or "us" in these terms. How we process data is described in the Privacy policy.
- Contact email: [email protected]
If the operator changes, we will publish a new version of these terms and ask you to accept it (section 20).
3. Definitions
- Service, GymDay — the gymday.fit website, the GymDay iPhone app and connecting an AI assistant to GymDay.
- Account — your GymDay account: email and password.
- Your data — everything you have recorded or uploaded: workouts and sets, plans, your own exercises, notes and photos for exercises, body measurements, settings.
- Health data — body weight, height, circumferences and other body measurements, as well as measurement types you created yourself.
- Catalog — GymDay's standard exercises with their descriptions, images and videos.
- AI assistant — a program made by another company that you connect to your account yourself.
- Coach hints — weight and rep suggestions that GymDay calculates from your own past records.
4. Age
You can use GymDay from the age of 13. If you are under 18, you need the consent of a parent or another legal guardian — to these terms and to the processing of your data.
By accepting these terms, you confirm that you are at least 13 and, if you are under 18, that you have that consent. We do not verify age. If we are told that a child under 13 is using an account, we will write to the account email and ask the account owner to delete it in the profile. We do not delete an account ourselves on the basis of an email (section 5).
5. Account and sign-in
- One account is for one person. Use an email address that is yours and that works: confirmation, sign-in and password reset emails go there.
- Do not share your password. If you think someone else has signed in to your account, change your password and tap "Log out on all other devices" in your profile.
- Signing in, changing your password or email, downloading your data and deleting your account are done only with the service itself — on the website or in the app. Support does not hand an account over to another person, does not change the email or password, does not delete the account or data and does not send data by email.
6. Support and requests
- Support is the [email protected] mailbox. There are no other channels. We try to reply, but we do not promise a response time — except for personal data requests, which we answer within the time limits set by law.
- You can do almost everything with your data yourself: view, correct, download and delete it. Send data requests from the account email. We reply only with a new email to the account email, not to the reply address of your message.
- By email we do not say whether an account exists, do not disclose its data and do not take any action on it: everything about a specific account is done in the profile. If the action you need is not in the profile, we will reply with how to do it.
- We may decline manifestly unfounded or excessive requests, including repetitive ones, to the extent the law allows.
- Send formal claims and notices to the same address.
7. The app without an account and data on your device
- The iPhone app also works without an account. In that case your data is stored only on the phone: we do not have it and cannot restore or export it on our side.
- Phone backups are made and kept by the device maker under its own rules. We have no control over them.
- If you delete your account, data already saved in the app stays on the phone. To remove it from the phone as well, delete it in the app or delete the app.
- Deleted records and withdrawal of consent to health data are synced to the phone too.
8. Your data
- Your data belongs to you. We do not sell it, and we do not compare you with other people.
- So that the service can work, you allow us to store and process your data: move it between your devices, calculate Progress and coach hints from it, build your export and pass data to an AI assistant you have connected — within the rights you have granted it. This permission is free, non-exclusive and only for running the service. It ends when you delete the data or your account, except for keeping backups and service records for the periods set out in section 11 of the Privacy policy.
- You are responsible for what you upload. Import files, notes and photos must contain your own data or data you have the right to use.
9. Export, import and deletion
- Export. You can download your data — workouts, plans, your own exercises, notes, measurements and settings — in your profile on the website at any time, including before deleting your account. Export is free. We may limit how often it can be requested and delay building it under high load, but we do not make it paid. Restricting access to an account — section 18. You can open photos for exercises on the exercise card and save them one at a time with your browser or phone.
- Import. You can bring records in from a file — a GymDay export or a spreadsheet made from our template. Before anything is written, we show what will be added and ask you to confirm.
- Account deletion. You can delete your account in your profile — on the website or in the app. Once it is deleted, your data becomes unavailable in the service immediately and cannot be restored. Backups and service records are deleted within the periods set out in the Privacy policy.
10. Sync between devices
With an account, your records sync between the website and the app. The app records workouts without a connection and sends them once it is back. If the same record is changed on two devices before they have synced, one of the versions is kept.
11. Health data
Body weight, height and measurements are health data. We store them only with your separate consent: GymDay asks for it the first time you record a measurement or your height. You can withdraw consent in your profile — your height, measurements and your own measurement types are then deleted and cannot be restored.
An AI assistant receives health data only if, when connecting it, you separately allowed it to read that data. More in the Privacy policy.
12. AI assistant
- You connect an assistant yourself: you sign in to GymDay on our screen and choose what to allow. It always reads your records; you can additionally allow it to read health data and make changes. You can disconnect an assistant at any time in your profile, under "Connected assistants".
- We carry out an assistant's requests within the rights you granted it in the same way as your own.
- An assistant is a program made by another company and works under that company's rules. We do not control what it sends to its maker or what it tells you.
- An assistant can misunderstand your request or text it has read — your records, notes, import files. Connect only assistants you trust, and check the changes they make.
- Where possible, the service lets you confirm or undo an assistant's action.
- A file imported through an assistant is written only after you confirm it — in the window the assistant's app shows or on the GymDay website. We treat a confirmation sent from the assistant's app as yours.
- GymDay does not create training plans. An assistant's answers are not our recommendations.
13. Not medical advice
- Coach hints are calculated automatically, by fixed rules, from your records only. They are not a training plan and not advice from a coach or a doctor. You can turn coach hints off in settings.
- Technique descriptions in the catalog are reference material.
- Progress shows calculations from your records, not an assessment of your health.
- Strength training carries a risk of injury. You choose the weight, reps and load yourself. If you have a medical condition, a recent injury or are pregnant, talk to a doctor.
14. What you must not do
- Sign in to other people's accounts, hand over your own, create accounts in someone else's name or in bulk.
- Access the service with programs other than through the website, the app or an assistant connected on our screen. Automatically extract the catalog, its descriptions, images or videos.
- Get around the service's limits and protection, or create load that disrupts it. Look for vulnerabilities only under the rules in section 21.
- Store files or material unrelated to your training in photos, notes or other fields. Upload illegal material, material that infringes other people's rights, or other people's personal data without the right to do so.
To protect the service, we may limit the rate and volume of requests. We may remove or hide material that breaks these terms or the law. We are not obliged to disclose which checks were triggered.
15. GymDay materials
The service interface, the exercise description texts and the GymDay name belong to the operator or are used by it under licence. You may use the catalog — descriptions, images and videos — in the service for your own training. Copying it or publishing it elsewhere is not allowed.
16. Price
GymDay is free today. While the service runs, export, sync, import and access to your whole recorded history stay free. We may introduce paid features; their terms will be described before you have to pay for them.
17. Availability and changes to the service
- We work to keep the service reliable, but we do not promise it will run without interruptions or errors. We offer the service as it works today.
- We may change, add and remove features. To keep working with the server, the app may sometimes need an update.
- We may shut the service down. If we do, we will announce it on the website in advance and leave time for you to download your data.
18. Restricting access
- You can stop using the service at any time and delete your account (section 9).
- We may restrict or suspend access to an account if you break these terms, threaten the security of the service or of other people, or if the law requires it. We will tell you about the restriction at the account email and, where the law and security allow, leave you a way to download your data.
19. Liability
To the extent the governing law allows (section 22):
- we are not liable for injuries or harm to health during training, or for decisions made on the basis of coach hints, Progress or an assistant's answers;
- we are not liable for third-party programs and services — assistants, the app store, your device — or for data that was stored only on a device;
- we are not liable for lost profits or other indirect losses.
These terms do not limit any liability that the law does not allow to be limited or excluded.
20. Changes to these terms
- We publish a new version on this page with its number and date. Earlier versions remain in the archive on this page.
- When the terms change, the website shows the new version and asks you to accept it; in the app this screen appears in the version that has it. Until you accept the new version, you can download your data or delete your account.
- If you use the app without an account, the new version applies from the date it is published.
- If you do not agree with the new version, download your data and delete your account.
21. If you find a vulnerability
Write to [email protected]. Test only on your own account and do not access other people's data. Do not guess passwords or codes, do not create load, do not contact support on behalf of another person and do not use tools for mass requests. Do not publish details until the vulnerability is fixed. We do not pay rewards for reports.
22. Governing law and disputes
These terms are governed by the law of the Republic of Kazakhstan. We suggest first trying to settle any dispute by writing to [email protected]. If that does not work, the dispute is heard by a court under the procedure set by that law. If you are a consumer and the law of the country where you live gives you rights that cannot be waived by contract, these terms do not take them away.
23. The iPhone app
The GymDay iPhone app is distributed through the App Store. In addition to these terms, Apple's standard licence agreement for apps applies to it. For any question about the app — how it works, your data, support — contact us.
24. Other
- If any provision of these terms turns out to be invalid, the rest remain in force.
- These terms together with the Privacy policy are the entire agreement between you and the operator about GymDay.
- We send messages about your account and the service to your account email. Keep it up to date.
- GymDay emails come only from addresses on the gymday.fit domain. We never ask for your password and never send sign-in links you did not request.
- We may use ideas and suggestions you send us without any obligation to you.
